Despite leading to the deadliest arson - convicted of murder with indifference
The Supreme Court accepted the appeal of Suhil Garban, who was convicted of aggravated murder after setting a car on fire and causing the death of Hilmi Garban, 77. The Court ruled that he should be convicted of basic murder, without special cruelty, and returned the case to the Haifa District Court for a new sentencing.
The Supreme Court accepted the appeal of Suhil Garban, who was convicted in the Haifa District Court of aggravated murder and arson, after setting a car on fire and causing the death of Hilmi Garban, 77. The incident occurred on February 12, 2021, when a Molotov cocktail was thrown into the victim's car while he was sitting in it. The victim suffered severe burns and died four days later. The defense argued that the arsonist did not notice the person in the car. Supreme Court Justice David Mintz ruled that this was murder with indifference, but not with special cruelty, as the action lasted only a few seconds. Justices Gila Canfy-Steinitz and Ruth Ronen agreed. The case was returned to the Haifa District Court for a new sentencing, but there is a possibility that a life sentence will be imposed again.
