Prof. Adam Shinar, a legal expert, analyzed in an interview with Radio 103FM the High Court's decision in the case of Sami Abu Shahada's disqualification from running in elections. According to him, the Supreme Court acted in an evasive manner: while a majority of five justices supported the disqualification, the court refrained from writing a clear ruling that would change the existing precedent, under which there was no grounds to disqualify Abu Shahada. A minority of four justices opposed the disqualification and refused to write a ruling, creating a dilemma. Shinar rejected claims of left-wing political bias in the court, noting that five justices supported the disqualification. However, he raised speculation that the national sentiment after October 7 influenced the decision, as he said that had Abu Shahada presented similar text four years ago, he would not have been disqualified. Shinar added that Justices Stein and Mintz display a narrow perception regarding the right to vote and be elected, and their threshold was lower from the outset.
