Minister rushed to declare the shelters as antiquities - ministry legal adviser warned: It will be blocked in the High Court, we are in elections

Heritage Minister Amichai Eliyahu declared the death shelters on Route 232 as antiquities, but his ministry's legal adviser, attorney Hanan Erlich, claims he was not consulted on the decision. In a sharp letter, Erlich warns that the declaration was not legally or professionally examined, no staff work was done, and its chances of withstanding judicial review are very low, especially during an election period.

Heritage Minister Amichai Eliyahu declared the death shelters in the Gaza envelope, along Route 232, as antiquities under the Antiquities Law. However, the legal adviser of his ministry, attorney Hanan Erlich, sent a sharp letter claiming he was not consulted on the decision, no staff work was done, and the declaration was not legally or professionally examined. Erlich warns that the chances of the declaration withstanding judicial review are very low, especially during an election period. He notes that no movable property has ever been declared an antiquity in Israel, and the declaration could be overturned in the High Court. The dispute arose against the backdrop of the Eshkol Council's intention to move the shelters from their location, apparently to the Nova site. Erlich calls for orderly staff work and examination of all aspects.
