The High Court of Justice postponed until after the elections a decision on whether to compel the government to establish a state commission of inquiry into the tragedy of October 7. By January 15, the authorities must present their position to the court and report what steps they plan to take regarding the commission. Thus, the issue of establishing the commission will effectively be passed on to the next government, after which the High Court will decide whether there are grounds for intervention. The justices supported the position of Attorney General Gali Baharav-Miara, who proposed in August to delay the matter until a new government is formed. In her assessment, during the pre-election period, the current government must observe the principle of restraint. At the same time, Baharav-Miara has not changed her position: she still considers a state commission the only independent and suitable body for investigating the failure of October 7. The government also opposed the High Court's intervention, but cited a different reason. In July, the authorities told the court that the Knesset had not managed to pass the bill on establishing the commission in its second and third readings before the start of the pre-election recess.
