The US state of Pennsylvania has enacted a law requiring disclosure of the use of AI-generated or AI-modified content in advertisements that create a misleading impression of goods and services. Governor Josh Shapiro signed the legislation in October 2026, making it Act 99 of 2026, with implementation to begin 60 days after its passage, not immediately upon signing. The law passed the state Senate by a vote of 48 to 2 and the House by 163 to 40. The legislation does not constitute a ban on the technology, nor does it require a label on every advertisement that uses it. It includes exceptions for satirical content, parody, commentary, and criticism, as well as clearly fictional content and text-only material. Enforcement is handled by the Attorney General or the relevant local prosecutor, with a civil penalty not exceeding $3,000.
