The Be'er Sheva Magistrate's Court approved a settlement under which he will receive total compensation of 290,000 shekels, without the defendants admitting liability.
A resident of Netivot, a self-employed accountant, experienced a traumatic event in February 2019 when the elevator he was riding with his partner fell, leaving him trapped for about 40 minutes. He was injured in his back, pelvis, and head, and was rescued by firefighting teams. After the incident, his condition deteriorated: he began using a cane and later a wheelchair, and suffered from severe anxiety about elevators and post-traumatic stress disorder. The legal battle revolved around whether the accident worsened his medical condition, as before the incident he suffered from a degenerative muscle disease with a recognized disability of 85 percent. An expert appointed by the court determined that the accident caused an additional 10 percent deterioration. After negotiations, a settlement was approved under which he will receive total compensation of 290,000 shekels, with RIT 1, RIT.AL.VY Management, and Harel paying 145,000 shekels, and Schindler Nachushtan Elevators paying an additional 145,000 shekels. The agreement was reached without the defendants admitting liability.
