The Battle Over Compensation: When Can a Municipality Limit Residents?

A legal battle in Netanya ended with the municipality retreating from its demand to limit the additional space in a renovation project to 12 square meters. Following a court ruling, some residents will be able to receive apartments about 40 square meters larger than their previous ones. The fundamental question of the authorities' power to limit compensation remains open.

A legal battle between apartment owners in the Dora neighborhood of Netanya and the Netanya municipality ended with the municipality withdrawing its demand to limit the additional space in a renovation project to 12 square meters. Following a ruling by the Central-Lod District Court, which accepted the residents' petition, the municipality reconsidered its position and announced that its 2019 compensation policy does not apply to the complex, since the plan was discussed in the municipality as early as 2013. Some residents will be able to receive new apartments about 40 square meters larger than their old ones. However, the fundamental question of whether a local committee has the authority to limit compensation in urban renewal projects remains open, as the process ended without a sweeping decision. Attorney Dikla Mosri Tal explains that many authorities have adopted policy documents to limit compensation, but in her opinion, such a document cannot determine who will receive the compensation apartments, as this is a proprietary issue.
