Appeal against the conviction of Diyar al-Omari's killer and demand to increase his sentence
The prosecution filed an appeal to the Supreme Court against the conviction of Denis Mokin for the murder of the martyr Diyar al-Omari from the village of Sandala, demanding to change the classification of the crime from reckless murder to premeditated murder, and to increase his sentence of 22 years, in a crime that occurred in May 2023.
The prosecution filed an appeal to the Supreme Court against the decision of the Central District Court in Nazareth convicting Denis Mokin for the murder of the martyr Diyar al-Omari from the village of Sandala, demanding to change the classification of the crime from reckless murder to premeditated murder, and to increase the sentence of 22 years. The crime occurred in May 2023. Attorney Omar Khamisi, director of the Mizan Human Rights Organization, which is following the case alongside the martyr's family, said that the appeal aligns with the family's position since the conviction decision, noting that they rejected considering the crime as reckless murder and insisted on convicting Mokin of intentional and premeditated murder. Khamisi explained that determining the nature of the crime requires examining the totality of the convict's actions before, during, and after the shooting, and not treating each act in isolation from the overall context of the crime. He added that aiming the weapon and repeated firing, as well as the racist statements made by the convict after the crime, constitute data supporting the demand for a conviction of premeditated murder. Khamisi noted that the Central District Court panel was divided on the classification of the crime, as one judge found that the evidence required convicting Mokin of premeditated murder, while the majority of the panel adopted his conviction for reckless murder.
