The Nazareth Magistrate's Court will hear tomorrow, Thursday, an objection by Sheikh Kamal Khatib's legal team to the Community Service Commissioner's recommendation that he is unsuitable for serving his prison sentence through community service. The recommendation was based on assessments by the Shin Bet and police that assume Khatib might exploit his public standing for incitement. The court had sentenced Khatib in July to nine months in prison to be served through community service, subject to the commissioner's approval, who later recommended rejecting this option without providing concrete factual data, according to the defense team. The defense, which includes lawyers from Adalah and Al-Mizan centers, argues that the recommendation exceeds the commissioner's authority and interferes with the court's jurisdiction, demanding its rejection and requiring the commissioner to designate a location for serving the sentence, or disclose the security materials on which the assessments were based, and allow cross-examination of those who prepared them before a final decision.
