Hundreds of thousands of shekels: Reservist evicted in disgrace from his home - now the compensation arrives
A reservist will receive half a million shekels in compensation after his family was evacuated from their home and he did not receive a salary from his workplace for nearly six months. The labor court rejected the company's claims to deduct previously paid amounts and ruled that it must pay the employee all his rights, including severance pay and compensation for emotional distress.
A reservist will receive compensation of over half a million shekels after the labor court ruled that his employer violated his rights during his military service. The employee, whose family was evacuated from their home during the war, did not receive a salary for five consecutive months, even though the company received compensation from the National Insurance Institute for his reserve duty. The court rejected the company's claim that it was entitled to deduct amounts paid in the past and ruled that it must pay the employee all his rights, including pension contributions, severance pay, vacation pay, and compensation of 25,000 shekels for emotional distress. The court emphasized the exceptional harm to the employee, who had to cope with family and financial hardship precisely during his service. However, the court took into account the company's cash flow difficulties following the war and refrained from awarding delay damages, and also dismissed the claim to impose personal liability on the company's CEO and a shareholder.
