The payment is not automatic: each affected passenger must prove the damages incurred and their direct connection to the onboard incident. The legal basis for claims is the Montreal Convention, which in Israel is implemented through the Air Transport Law of 1980. Attorney Shai Ben-Haim explained that the liability limit under Article 21 of the convention is 151,880 Special Drawing Rights, equivalent to approximately $210,000 or 600,000 shekels. Aviation law specialist Boaz Regev noted that the deadline for filing a lawsuit is two years from the date of the incident. A psychiatric evaluation may be required to confirm psychological damages. Passengers can file lawsuits in Israel, as foreign airlines must have a local representative. A class action lawsuit is also possible, though lawyers consider it not an obvious option due to the individual nature of the damages. Additionally, Israeli passengers may receive assistance through the Law for Compensation of Victims of Hostile Acts, which provides treatment and payments through the National Insurance Institute, including for PTSD.
