McFadden was arrested shortly after the incident. At a hearing over the weekend, the judge ruled there is enough evidence to move the charge forward before a grand jury. Her attorney, Artisha Gregg, said it was a tragic accident that was not intentional. Brooks' family emphasized that the two were not a couple and that they did not know McFadden. If convicted, she could face up to ten years in prison. The next hearing is set for October 21.
