However, due to the election period, she proposed allowing the next government to decide on the matter and submit an update to the High Court after its formation. She criticized the delay of about two years and ten months, which could harm the effectiveness of the investigation and lead to evidentiary damage.

The Attorney General, Gali Baharav-Miara, submitted today (Wednesday) a response to the High Court of Justice regarding the investigation of the October 7 events and the war. In her response, she reiterated that a state commission of inquiry is "clearly, the appropriate and designated legal tool" for examining the events, and that its professional independence and detachment from the political echelon would enable a professional, effective, and independent investigation. However, since the current government has not yet made a decision on the matter, and the country is in the midst of the election period for the 26th Knesset, the Attorney General believes that the rules of restraint and moderation applying to an outgoing government should be taken into account. Therefore, she proposed allowing the government to be formed after the elections to discuss the issue and make the decision, and to submit an updated notice to the High Court shortly after its formation. The Attorney General criticized the delay, noting that about two years and ten months have passed since the outbreak of the war without the government determining the format of the investigation or its start date, a situation she defined as "most exceptional" that could harm the effectiveness of the investigation and even lead to evidentiary damage.
