The court upheld the decision of the medical appeals committee, according to which the victim has no permanent disability in the lumbar and cervical spine. A key element was the cervical spine MRI presented by the victim: the committee refused to consider it because the document did not specify who performed the interpretation and in which institution the study was conducted, and the conclusion was likely signed outside Israel. The judge noted that the committee should have clarified the details, but the case was not returned for re-examination. The Institute insisted that the degree of disability is determined based on clinical data, and the examination showed a normal range of motion. As a result, the victim was left without recognized disability. The parties may file a petition with the National Labor Court within 30 days.
