Ben Gvir again in court: Delayed appointment of senior Lahav 433 official - and did not provide reasons

National Security Minister Itamar Ben Gvir is once again facing a petition to the High Court of Justice: Chief Superintendent Itzik Alfasi petitioned the court after Ben Gvir refrained from approving his appointment as spokesperson for the Investigations and Intelligence Division and Lahav 433, despite being selected in the placement process and receiving the recommendation of the Police Commissioner. The petition claims that the avoidance was done without professional reasons, and that the deputies to the Attorney General warned in July that delaying appointments could harm the independence of law enforcement.

National Security Minister Itamar Ben Gvir is once again facing judicial scrutiny, after Chief Superintendent Itzik Alfasi petitioned the court against his decision to delay his appointment as spokesperson for the Investigations and Intelligence Division and Lahav 433. The petition claims that Ben Gvir refrained from approving the appointment even though Alfasi was selected in the placement process and received the recommendation of the Police Commissioner and senior command staff, and that the avoidance was done without proper administrative procedure and without professional reasons. It further claims that the accumulation of circumstances raises concern that the decision was based on extraneous considerations. The deputies to the Attorney General addressed the matter in a letter to Ben Gvir in July, warning that delaying appointments in sensitive divisions could harm the independence of law enforcement. Alfasi is asking the court to intervene and order the completion of his appointment process, arguing that the gap between the professional recommendations and the minister's conduct requires judicial review.
