According to the indictment, in the first count, Roth lured a 7-year-old boy with a promise of money, led him to a construction site, and committed an indecent act. About five months later, in the second count, he led a 6-year-old minor to a hiding place and then to a nearby synagogue, where he committed a series of serious sexual offenses, including rape. The prosecution emphasized the escalation between the two incidents and the severe harm to the children and their families. It also argued that the court did not give sufficient weight to the danger posed by Roth, as indicated in probation service reports, which noted that the existence of pedophilic sexual deviation could not be ruled out. Meanwhile, Roth filed an appeal against the district court's decision not to ban the publication of his name, and the Supreme Court rejected the appeal.
